“Part One: Doing Business With the Commonwealth: ITB, ITQ, RFP...wth?”

Course Description:  This two-part CLE will give you the basic tools you need to explore contracting opportunities with the Commonwealth of Pennsylvania, for both your business clients and your firm. 

The first session, “ITB, ITQ, RFP...wth?”, will review the different types of procurements. It will also explain how both service providers and suppliers can get cooperative purchasing contracts allowing them to deal with not only Commonwealth agencies, but local governments and non-governmental organizations as well, without the necessity of competing for the work. The Commonwealth's contracting process can be confusing for those who haven't had experience with its somewhat complicated structure, but knowing the basic concepts will give you the tools needed to advise your clients and to help them prepare bids and proposals with a greater likelihood of success.

The second session, “Girding For Battle” (April 11, 2023), will discuss what to do when there’s a dispute on an existing Commonwealth contract for both prime and sub-contractors: administrative remedies to explore, the exclusive initial agency appeal jurisdiction and function of the Board of Claims, and further appeals from the Board to the Commonwealth and PA Supreme Courts. 

Participating faculty includes William W. Warren Jr., partner, Saul Ewing LLP and former chief counsel to the PA Department of General Services and chief of litigation in the Governor's Office of General Counsel; C. Grainger Bowman, of counsel at K&L Gates and past chairman of the PBA's Civil Litigation Section and Construction Litigation Committee; and Jan Matthew Tamanini of JMT Law, LLC, former PennDOT Senior Counsel for Contracts and Legal Services and former Assistant Chief Counsel for Public Works and Senior Counsel for Procurement at the PA Department of General Services.

William W. Warren Jr.
William W. Warren Jr. Saul Ewing LLP

Bill Warren is a member of the Real Estate, Construction and Government Contracts practices. He has worked extensively on governmental procurement of technology, equipment, commodities and services, and public, nonprofit and private construction programs, and as a commercial litigator in the federal Middle District of Pennsylvania, and in a wide variety of state administrative law matters.

Bill represents technology vendors, design firms, and contractors in state construction and technology procurement contract negotiations and dispute resolution processes. He also represents school districts, counties, cities, municipalities and authorities in contracting and construction matters.

Prior to joining Saul Ewing, Bill was chief counsel in the Pennsylvania Department of General Services where he was responsible for the legal aspects of the Commonwealth's building construction, commodity procurement and leasing programs.

Bill was thereafter appointed chief of litigation in the Office of the General Counsel, responsible for monitoring and supervising significant litigation involving the executive agencies such as Transportation, General Services, and Environmental Protection, Insurance, Revenue, and Public Welfare.

Jan Matthew Tamanini
Jan Matthew Tamanini JMT Law, LLC

Jan, a Harrisburg-based attorney, has been a plain language devotee since her pre-law-school years working as a broadcast and print journalist. With a solo practice in business and estate law, Jan has been a CLE instructor for the PBA and PA Bar Institute for both business law and legal writing/effective communication.

A member of the PBA’s Plain English Committee since its inception in the mid-1990s, Jan chaired the committee from 2010 through 2015. She has held writing and editorial positions for regional and national legal and non-legal publications. Jan was one of nine US solo attorneys profiled in Carolyn Elefant’s book, Solo by Choice, The Companion Guide: 34 Questions That Could Transform Your Legal Career, published in June 2011.

As a writer, Jan has been a frequent contributor to online and print publications for lawyers, businesses, and animal welfare groups. She has served on national, state, and local bar association committees and councils. Jan also has worked on the boards of several nonprofit organizations, particularly for domestic violence services, the arts, Alzheimer’s Disease, AIDS patient relief, and animal welfare.

Before founding her law firm in 2007, Jan worked in state government for over 25 years (with the Independent Regulatory Review Commission, Securities Commission, PennDOT, Governor’s Office of the Budget, and Department of General Services). She represents business clients in administrative matters and contract claims against state agencies at the Commonwealth of Pennsylvania Board of Claims.

A committed advocate for greyhound adoption, she has two retired racers at home as well as six “greyt” angels. She’s also proud mom to two accomplished adult children and grandma to two.
